Please read these Terms of Service carefully before using malwaland.com. These terms govern your access to and use of Malwaland's home services marketplace platform.
1. Acceptance of Terms
By accessing or using Malwaland you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. We may update these terms at any time; continued use after updates constitutes acceptance.
2. Description of Service
Malwaland is an online marketplace that connects customers seeking home services (such as electrical work, plumbing, AC repair, painting, carpentry, etc.) with independent local service providers in Punjab, India. Malwaland facilitates connections but is not a party to any service agreement between customers and providers.
3. Eligibility
You must be at least 18 years old to register and use Malwaland. By using the platform, you represent that you meet this requirement and that all information you provide is accurate and truthful.
4. Customer Responsibilities
As a customer, you agree to: provide accurate information in service requests; treat service providers with respect; pay agreed fees directly to the provider; and not misuse the platform to spam, harass, or defraud providers. Malwaland is free to use for customers and does not charge any commission or booking fees.
5. Provider Responsibilities
As a service provider, you agree to: provide accurate business information and keep your profile up to date; deliver services professionally and as described; hold any required licences or certifications for the services you offer; respond to leads in good faith; and not misrepresent your qualifications or credentials. Malwaland reserves the right to remove provider profiles that violate these terms or receive consistent negative feedback.
6. Prohibited Conduct
You must not: post false, misleading, or fraudulent information; use automated tools to scrape or harvest data; circumvent security measures; use the platform for any illegal activity; spam or harass other users; or attempt to solicit users off-platform to avoid Malwaland's processes. Violations may result in immediate account suspension or termination.
7. Disclaimer of Warranties
Malwaland provides its platform "as is" without warranties of any kind, express or implied. We do not guarantee the quality, safety, or legality of services offered by providers, the accuracy of listings, or that the platform will be uninterrupted or error-free. You use the platform and engage with providers at your own risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Malwaland shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any services booked through it. Our total liability to you for any claim shall not exceed ₹1,000 or the amount you paid to us in the past 12 months, whichever is greater.
9. Intellectual Property
All content on Malwaland — including the logo, design, text, and code — is owned by or licensed to Malwaland and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our written permission. By submitting content (such as business descriptions or photos), you grant us a non-exclusive licence to display that content on the platform.
10. Account Termination
You may delete your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm the platform or its users. Upon termination, your right to use the platform ceases immediately.
11. Governing Law
These Terms of Service are governed by the laws of India. Any disputes arising from your use of Malwaland shall be subject to the exclusive jurisdiction of the courts in Bathinda, Punjab, India.
